The limitations above shall apply notwithstanding any failure of essential purpose of any limited remedy. Certain states do not allow limitations on implied warranties or exclusion of incidental or consequential damages, so the above limitations may not apply to you in their entirety.

Notwithstanding the above, either party may pursue claims in small claims court for disputes that qualify under applicable rules, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm pending arbitration.
